NCA POLYMERS LLC - Terms and Conditions for Services and Products

1. Introduction These Terms and Conditions (“Terms”) govern the sale and provision of services and products by INCA POLYMERS LLC. (“Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). By purchasing products or services from INCA POLYMERS LLC., you agree to be bound by these Terms. Please read them carefully.

2. Products and Services INCA POLYMERS LLC. provides high-quality polymer products and services. The specifics of the products and services offered, including specifications, pricing, and delivery terms, will be outlined in individual agreements or invoices.

 

3. Orders

  • All orders placed by the Customer are subject to acceptance by INCA POLYMERS LLC. The Company reserves the right to reject any order for any reason.

  • Orders will be confirmed via an invoice or written acknowledgment, which will detail the scope, pricing, and terms for delivery.

4. Pricing and Payment

  • Prices for products and services are subject to change without prior notice. However, once an order is confirmed, the agreed-upon price will be honored for that order.

  • Payment terms are specified on the invoice. Unless otherwise agreed in writing, payment is due upon receipt of the invoice.

  • We and/or our service partners, accept payment through [bank wire transfers or check by mail].

  • Late payments may be subject to interest charges as outlined in the invoice, or as otherwise agreed upon.

5. Delivery

  • Delivery terms, including shipping costs and estimated delivery times, will be specified on the invoice or purchase order.

  • INCA POLYMERS LLC is not responsible for any delays or damages that occur during the shipping process once the products have been transferred to the carrier.

  • Risk of loss or damage to products passes to the Customer once the products are delivered to the Customer’s specified address.

6. Returns and Refunds

  • Products may be returned or exchanged only if they are defective, damaged, or incorrect due to an error by INCA POLYMERS LLC.

  • Returns must be made within [30] days of receiving the products.

  • All returns or exchanges must be pre-approved by INCA POLYMERS LLC, and the Customer is responsible for the return shipping costs unless the return is due to an error by the Company.

  • Refunds will be issued in the same form of payment used for the original transaction.

7. Warranties

  • INCA POLYMERS LLC provides a limited warranty on products that are free from defects in material or workmanship under normal use and service for [insert period] from the date of delivery.

  • The warranty does not cover damages caused by misuse, improper installation, or unauthorized modifications.

  • For services, INCA POLYMERS LLC will provide services in a professional manner, but makes no warranties beyond the scope of the service agreement.

8. Limitation of Liability

  • INCA POLYMERS LLC’s liability for any claim arising from the purchase or use of our products or services is limited to the amount paid for the product or service in question.

  • INCA POLYMERS LLC will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use our products or services.

9. Intellectual Property:

  • All intellectual property rights related to the products and services provided by INCA POLYMERS LLC, including trademarks, copyrights, patents, and trade secrets, remain the property of INCA POLYMERS LLC. and/or it's supply partners.

  • The Customer agrees not to distribute any of products blended or stand-alone compound, or any intellectual technical data property belonging to INCA POLYMERS LLC. and/or our producing partners without prior written consent.

10. Confidentiality:

  • Both parties agree to keep any confidential or proprietary information exchanged during the course of the agreement confidential and not to disclose it to any third parties without the prior written consent of the disclosing party.

11. Force Majeure: INCA POLYMERS LLC will not be held responsible for any failure to perform or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, or acts of government.
